1. Agreement to Terms

By accessing or using PricingMonitor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PricingMonitor is an automated monitoring service that tracks competitor SaaS pricing pages and feature lists. The Service monitors competitor websites 24/7 and sends alerts via email or Slack when changes are detected. We provide historical data storage, change detection, and notification services.

3. User Accounts

To use our Service, you must:

Create an account with accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription Plans and Billing

PricingMonitor offers various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to:

Pay all fees associated with your selected plan
Automatic renewal of your subscription unless cancelled
Price changes with 30 days advance notice

All fees are processed through Stripe and are charged in advance on a recurring basis according to your billing cycle.

5. Refund Policy

We offer refunds for subscription fees if requested within the first 15 days of your initial subscription. Refund requests must be submitted to [email protected]. After 15 days, all fees are non-refundable. Refunds will be processed to the original payment method within 5-10 business days.

6. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any portion of the Service
Use automated systems to access the Service without permission
Monitor websites without proper authorization or in violation of their terms

7. Intellectual Property

The Service and its original content, features, and functionality are owned by PricingMonitor and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any damages resulting from service interruptions or modifications.

9. Limitation of Liability

To the maximum extent permitted by law, PricingMonitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use the Service will immediately cease
All data associated with your account may be deleted
You remain responsible for all charges incurred prior to termination

You may cancel your subscription at any time through your account settings or by contacting support.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nice, France.
